Roll-off Container Service Terms & Conditions

1. Responsibility for Equipment
All containers remain the property of CFT Recycling at all times.
The Customer is fully responsible for the care, condition, and proper use of the container from the time it is delivered until it is collected by CFT Recycling.
The Customer assumes liability for any loss or damage occurring while the container is:
- On site
- Being loaded or unloaded
- Awaiting pickup
- Moved or repositioned by anyone other than CFT Recycling
2. Condition Upon Delivery & Reporting Requirements
The Customer must inspect the container immediately upon delivery and prior to loading or use.
Any pre-existing damage, defects, or concerns must be reported to CFT Recycling before the container is used.
Failure to report concerns prior to use constitutes acceptance that the container was delivered in good condition.
Once materials have been placed in the container, the Customer assumes full responsibility for any damage observed at the time of pickup.
CFT Recycling may document container condition at delivery and pickup for verification purposes.
3. Proper Use of Container
Containers must be used only for their intended purpose and in a manner that does not damage the equipment.
The following activities are strictly prohibited:
- Striking the container with heavy equipment
- Dropping or slamming concrete, asphalt, or dense material into the bin
- Using the container as a push wall or brace
- Dragging, lifting, or moving the container without written authorization
- Point-loading materials in a single area
- Loading above the top rail (“overfilling”)
- Placing the container on unstable, soft, or uneven ground
- Burning or torching materials inside the container
4. Accepted Materials
Unless otherwise agreed in writing, containers are intended for typical construction, demolition, or waste materials such as:
- Wood, drywall, and general construction debris
- Non-hazardous household or commercial waste
- Scrap metal (where applicable)
- Roofing materials (within weight limits)
5. Prohibited Materials
The following materials are not permitted unless pre-approved in writing:
- Hazardous waste of any kind
- Liquids, sludge, or contaminated soils
- Asbestos-containing materials
- Chemicals, paints, solvents, fuels, or oils
- Batteries, propane tanks, or pressurized containers
- Tires (unless specifically arranged)
- Refrigerants or appliances containing refrigerant
- Biohazards or regulated waste
- Any material restricted by provincial or federal regulation
If prohibited material is found, the Customer is responsible for:
- Removal costs
- Disposal fees
- Handling surcharges
- Regulatory penalties (if applicable)
6. Weight & Loading Limits
Customers must ensure materials are:
- Evenly distributed
- Loaded level with the top of the container
- Within legal hauling weight limits
CFT Recycling reserves the right to:
- Refuse pickup of unsafe or overloaded containers
- Remove excess material at Customer expense
- Apply overweight charges or return-trip fees
7. Damage to Rolloff Containers – Chargeback & Liability
The Customer is fully responsible for any damage to the container while under their control.
Damage includes, but is not limited to:
- Bent or twisted walls
- Damaged rails or top edges
- Cracked welds
- Warped floors from point-loading
- Broken rollers or door hardware
- Damaged tarp systems
- Structural distortion from overloading
- Complete container replacement where repair is not feasible
Damage may result from:
- Excavators, loaders, skid steers, or backhoes
- Improper loading methods
- Unauthorized relocation of the container
- Ground failure or improper placement surface
8. Chargebacks & Repair Costs
All damage will be billed at actual cost, including:
- Labour and materials
- Transportation and shop time
- Loss-of-use / downtime charges
- Replacement cost where applicable
Damage assessments are determined by CFT Recycling based on inspection and repair requirements.
9. Site Access & Placement
Customers must provide safe, legal access for delivery and removal.
The Customer is responsible for:
- Ensuring adequate clearance and ground stability
- Protecting private surfaces (driveways, curbs, landscaping)
- Obtaining any permits required for placement
CFT Recycling is not responsible for surface damage resulting from normal container service where conditions were not properly disclosed.
10. Waiting Time & On-Site Delays
Customers must ensure the site is ready for service at the scheduled time of delivery, exchange, or pickup.
CFT Recycling includes a 15-minute grace period at no charge.
Waiting time is calculated from the later of:
- The scheduled appointment time, or
- The driver’s actual arrival time on site
If the driver is required to wait beyond the 15-minute grace period due to site conditions not ready for service, waiting time will be billed in 15-minute increments at CFT Recycling’s standard hourly rate.
If delays prevent service from being completed, a trip charge and/or return-trip fee may also apply.
11. Right to Refuse or Suspend Service
CFT Recycling reserves the right to refuse service, suspend pickup, or remove equipment where:
- Unsafe loading is observed
- Prohibited materials are present
- Terms of use are violated
12. Indemnification
The Customer agrees to indemnify and hold harmless CFT Recycling from any claims, damages, penalties, or liabilities arising from misuse of the container or violation of these Terms.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the province in which the service is provided.
14. Acceptance of Terms
Use of the container constitutes full acceptance of these Terms & Conditions, whether signed or not.
